AZ-Specific Defenses

TILA/RESPA/HOEPA Violations

Federal lending law violations are the primary basis for civil suits in AZ non-judicial foreclosures.

Arizona Consumer Fraud Act

AZ state law protection against deceptive mortgage practices, with potential for treble damages.

Chain of Title Challenge

MERS/securitization defects and broken assignment chain as basis for wrongful foreclosure claims under A.R.S. § 33-807.

Arizona Homeowner Legal Rights

Arizona is a non-judicial foreclosure state under A.R.S. § 33-807 et seq. — 90-day NTS period, no post-sale redemption, civil lawsuit required to stop sale.

90-Day NTS Period

Under A.R.S. § 33-808, the Notice of Trustee Sale must be recorded at least 90 days before the sale date and published in a newspaper of general circulation. Defects in the NTS — improper recording, insufficient notice, or incorrect amounts — are grounds for a TRO and civil complaint.

AZ Consumer Fraud Act

The Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.) prohibits deceptive acts in consumer transactions including mortgage lending and servicing. Violations can be asserted as claims in civil lawsuits with treble damages and attorney's fees available.

No Post-Sale Redemption

Arizona provides NO post-sale right of redemption for non-judicial foreclosures. Once the trustee sale is completed, the property is gone permanently. Pre-sale legal action — filing a civil lawsuit with TRO application in AZ Superior Court — is the only effective defense.

Arizona Notice of Trustee Sale & Foreclosure Timeline

AZ non-judicial foreclosures are governed by A.R.S. § 33-807 et seq.:

Stage Timeline Legal Authority Homeowner Action
Notice of Trustee Sale Recorded 90+ days before sale; published & posted A.R.S. § 33-808 90-day window to file civil suit + TRO
Trustee Sale Public auction at date/time/location specified in NTS A.R.S. § 33-810 No post-sale redemption — file BEFORE sale

Total AZ timeline: approximately 90+ days from NTS recording. Act during the 90-day period — once the sale happens, you cannot get the property back.

Common Lender Violations in Arizona Foreclosures

TILA Violations

  • Inaccurate APR/finance charge disclosures — 3-year rescission (15 U.S.C. § 1635)
  • Notice of Right to Cancel not provided at closing
  • HOEPA high-cost loan violations — AZ has additional predatory lending protections

Remedy: Rescission, statutory damages, plus AZ Consumer Fraud Act remedies.

RESPA Violations

  • QWR not acknowledged within 5 days or responded within 30 days — 12 U.S.C. § 2605(e)
  • Misapplied payments, escrow errors, force-placed insurance
  • Dual tracking while modification application is pending

Remedy: Actual damages, statutory damages up to $2,000, attorney's fees.

AZ-Specific Violations

  • Improper NTS: Wrong recording, insufficient publication, incorrect legal description under A.R.S. § 33-808
  • AZ CFA Violations: Deceptive servicing practices — treble damages available
  • Beneficiary Authority: Foreclosing entity cannot prove authority to direct trustee sale

Wrongful Foreclosure Defenses

  • Lack of Standing: Foreclosing entity cannot prove authority under deed of trust
  • Defective NTS: Notice fails A.R.S. § 33-808 requirements — grounds for injunction
  • MERS/Chain of Title: Broken assignments in securitized AZ deeds of trust
