HB 356 Mediation Program

Under NRS 107.086, owner-occupied homeowners can elect state-supervised foreclosure mediation within 30 days of receiving the NOD. The lender must produce original loan documents, the note, and proof of authority to foreclose. Mediation can result in loan modification, forbearance, or settlement — and the lender can be sanctioned for bad-faith participation.

NV Deceptive Trade Practices Act

The Nevada Deceptive Trade Practices Act (NRS 598.0903 et seq.) prohibits deceptive acts in mortgage lending and servicing. Violations can form the basis for civil claims with statutory damages and attorney's fees — powerful leverage in non-judicial foreclosure defense.

No Post-Sale Redemption

Nevada provides NO post-sale right of redemption for non-judicial foreclosures under NRS 107.080. Once the trustee sale is completed, the property is permanently transferred. Pre-sale action — HB 356 mediation election AND civil lawsuit with TRO — is essential.
