Non-Judicial Foreclosure

Most common in SD County. Uses "power of sale" in deed of trust. No court involvement — must file civil lawsuit to stop trustee sale.

Recorded at SD County Assessor/Recorder/County Clerk. 90 days to cure default.

Notice of Trustee Sale (NTS)

Filed 90+ days after NOD. Sale date 21+ days out. Auction at SD County courthouse.

No post-sale redemption in CA. Must file civil lawsuit in SD Superior Court BEFORE sale.
